sidenote--83Rabbit: W00t! good legal analysis. Although I haven't studied Ebay cases, I wonder if there's an issue of buyers/sellers having minimum contacts through purposeful availment, or that they could reasonably anticipate being hauled into court in a state where they sell their product (which given the scope of ebay could be anywhere?) Interesting...of course I sucked at civ pro...
